INVITATION TO SUBMIT PROPOSALS

 

The Sussex County Municipal Utilities Authority is soliciting proposals from engineering professionals, licensed in the State of New Jersey, to provide Professional Engineering Services relative to the Authority’s Solid Waste Facility and, specifically, consulting services related to landfill gas design, operations and permitting for the period of 2009-2010.

The Professional Engineering Services sought include the following enumerated scopes of work as stated below.  Proposals shall include relevant individual and, if applicable, corporate team experience involving projects/services of similar detail, nature and scope, together with sufficient information and data so as to allow SCMUA to evaluate the responder’s professional background, abilities, credentials and experience (“Proposal”).  Proposal(s) will be accepted for one or multiple work scopes. 

1.         Landfill Gas (LFG) System Improvements:  Design and Bid Phase Services

            SCMUA is seeking Proposals for Design and Bid Phase Services for a Landfill Gas System Improvement Project consisting of approximately nine (9) new vertical gas collection wells, valving, piping and appurtenances to connect to existing gas collection system; extension of leachate/condensate force main and compressed air piping (approximately 250 l.f.) from Well EW-102 to Leachate Cleanout LC-2; installation of well dewatering pumps (with force main and air line connections) for existing/new wells (up to ten (10) total);  upgrade of existing LFG system condensate pump; and installation of a continuous gas analyzer (CH4/O2/CO2) at the flare.  The requested Design services shall consist of assistance to SCMUA staff  with the following: 1. Preparation of bid ready plans and specifications (including Notice to Bidders, Instructions to Bidders, Bid Proposal Form, General Conditions, Supplementary Conditions, Technical Specifications, and Contract Design Plans).  Deliverables shall consist of a master copy of reproducible plans and specifications, and copies in sufficient quantity for bidding, with an additional copy of said plans and specifications in electronic format.  SCMUA shall be responsible for survey services, proposer shall coordinate same.  Proposer shall further identify and coordinate all necessary permits;  2.  Design services shall also include review and evaluation of SCMUA’s Landfill Gas Collection System Plan (refer to document link below which is incorporated herein by reference), with recommendations regarding the proposed Landfill Gas System Improvement Project contemplated herein; and  3.  A project construction cost estimate is also required to be developed.  Bid Phase services shall include response to bidder questions, contract modifications or addenda as needed, review of proposed substitutions, bid tabulation, and recommendation for award.  Each Proposal shall be considered on a time and materials basis (per submitted rate schedule), with a proposed fixed cost ceiling that is not to be exceeded, except for agreed upon change(s) in project scope.  A Project Manager shall be designated for this work. 2.         Landfill Gas System Improvements: Resident Engineering and Inspection Services

            SCMUA is seeking Proposals for Resident Engineering and Inspection Services for the above-referenced Landfill Gas System Improvement Project.  The requested services shall provide for general administration of the construction contract as the SCMUA’s representative, including shop drawing review/approval, conducting a Pre-Construction Conference and Progress Meetings, resident engineering and inspection of work, providing clarifications or information as requested, review/approve payment requests, review/approve project schedules, coordinate permits, evaluation substitutes and “or equals”, testing, completion/punch-list, and record drawings.  Deliverables consist of a reproducible set of record drawings, including plans in electronic form.  Each Proposal shall be considered on a time and materials basis (per submitted rate schedule), with a non-binding estimate of total RE&I costs.  To receive consideration, a qualifying proposal must be submitted as well as a “cost saving” alternate proposal involving the utilization of existing SCMUA staff (Chief Engineer and Solid Waste Superintendent) to assist with construction inspection services.  Each of these alternatives will be evaluated/presented along with a revised RE&I cost estimate.  A Project Manager/Resident Engineer shall be designated in the Proposal together with sufficient professional background and experience information provided so as to allow SCMUA to review and analyze the Project Manager/ Resident Engineer who is proposed to be working with/at SCMUA in this regard.

3.         Solid Waste Litigation Support Services

            SCMUA is seeking Proposals for professional consulting services in support of its consolidated appeals of NJDEP Air Enforcement Notice of Violation/Administrative Order/Penalty Assessment and NJDEP Air Pollution Control Pre-Construction Permit and Certificate to Operate (Flare).  Services will include assistance to SCMUA legal and technical project team in preparation for a hearing with the NJDEP Office of Administrative Law set for July 6-9, 2009.  Issues involve air enforcement violations, Title V Operating Permit, NSPS, regulation of a landfill air pollution control device (flare), and regulation of landfill fugitive methane emissions.  Services may further include calculations, reporting, and testimony at deposition and before administrative law tribunal(s) as necessary as an expert witness, and consultation and recommendations regarding legal strategy regarding same.  Services may also include preparation of or coordination with SCMUA’s Annual Air Emission Statement(s).  Must have extensive knowledge of USEPA/NJDEP regulations and air permitting requirements.  The Proposal must contain sufficient professional background and experience information so as to allow SCMUA to review and analyze the Professional Engineer who is proposed to be working with/at SCMUA in this regard.  Each Proposal shall be considered on a time and materials basis (per submitted rate schedule).  Should any subconsultant work be proposed, a corresponding rate schedule and identification of area of expertise and proposed services shall be submitted.  A Project Manager shall be designated.

4.         Air Pollution Control Permit Monitoring & Compliance

           SCMUA is seeking Proposals for monitoring and compliance services relative to its Air Pollution Control Pre-Construction Permit/Certificate to Operate (PCP070001-83118, please refer to the attached link) for its landfill gas system and enclosed flare.  Proposals shall include review of said permit and development of a tiered sampling plan to comply with NJDEP requirements (A.  Emission Unit: LFG Collection and Control sampling/analysis/ reporting and, B.  Landfill Surface Methane monitoring/reporting), with identification of all proposed reporting parameters.  The proposals shall be considered on a lump sum (per sampling event) basis for A. and B. sampling plans, inclusive of field sampling and laboratory analysis.  Should any subconsultant work be proposed, a corresponding rate schedule and identification of area of expertise and proposed services shall be submitted.  All other associated permit consultations, as needed, shall be considered on a time and material basis per submitted rate schedule.  A Project Manager shall be designated. 5.         General LFG Operations & Maintenance Services

            SCMUA is seeking Proposals for professional landfill gas related consulting services, including operations and maintenance activities.  Services shall consist of miscellaneous professional engineering consultations on an as-requested basis, including assistance with NJDEP Annual Air Emission Statement(s), consultations regarding landfill gas system operational settings, and may further include LFG system monitoring (Landgem 1000), well field adjustments, system modifications or repairs, and other field related activities as necessary.  Proposals shall be considered on a time and materials basis per submitted rate schedule, with a distinction (if any) for office versus field services.  Should subconsultant work be proposed, a corresponding rate schedule and identification of proposed services shall be submitted.  A Project Manager shall be designated.

Proposals are being solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.4, et seq.  A valid NJ Business Registration Certificate must be submitted with the response along with any other required registrations and/or certificates, including Pay-to-Play forms and certifications as may be required.  The successful person or entity is responsible for acquiring and submitting all necessary documents, certificates and registrations at their own expense.  Qualifying Proposals shall remain on file at SCMUA and may be used for the procurement and performance of supplemental landfill gas related services for the period of 2009 through 2010.

The Professionals are being selected by the SCMUA based on an evaluation of the most advantageous proposal to each specific scope of work, and other factors.  Proposals will be evaluated in accordance with New Jersey Law on the basis of the following criteria:

1.                  Knowledge, skills and abilities regarding the subject matter of each enumerated work scope, including demonstrated and proven experience and familiarity in providing professional services to a New Jersey Solid Waste Authority related thereto.

2.                  Professional qualifications, availability, knowledge, skills, abilities and experience of each separately articulated proposed Project Manager with regards to in New Jersey Solid Waste Authority-related issues and familiarity and experience with NJDEP, USEPA, NJDCA, and any other applicable regulatory agencies. 

3.                  Understanding of the scope of work along with a good technical approach.

4.                  Quality of services provided.

5.                  Hourly Rate Schedule and Proposed Costs, where appropriate.

6.                  Ability to meet prescribed budgets.

7.                  Ability to meet prescribed schedules and project deadlines.

8.                  Ability to work well with Board of Commissioners, staff and professionals.

9.                  Such other factors demonstrated to be in the best interest of the SCMUA.

10.              General Reputation/References.

The Board of Commissioners will consider award of contracts and/or procurement of services based on criteria listed above.
